TDS responds to Wright County judge's decision

On Wednesday, Oct. 8, 2008, a Wright County Judge in the state of Minnesota rendered his circuit court opinion and decision in the litigation case between Bridgewater Telephone Co./TDS and the city of Monticello, Minn.

The following statement can be attributed to Drew Petersen, director of legislative and public relations for TDS Telecommunications Corporation:

“Having just received the decision from Judge Jasper late yesterday, TDS management and our legal team are reviewing the court's opinion and considering our alternatives.

“As we have stated numerous times, we take this litigation very seriously and have always viewed this case as purely a matter of questioning whether or not the City has statutory authority to issue revenue bonds to build a fiber network and compete with private enterprise.

“While disappointed with the court's decision, we believe Judge Jasper recognized, on several occasions, including in his written decision, the validity of our suit when he states, ‘the Court found that this litigation presented a substantial issue of statutory construction.’

“Further, this decision does not impact our current work in the city of Monticello. We will continue to move forward with our construction plan to complete our fiber network by the end of the year. We are confident our technical expertise, dedicated employees and long-term experience will prove to be a solid competitive advantage for TDS as we move forward bringing advanced communications services and innovative new products to the citizens of Monticello.”

 

TDS maintains a statutory 30-day window to determine whether or not to appeal the circuit court decision.
